probable tbat matters would be fairly ’adjustecl,
but as soon as an arrangement was come to tbe
opposition was eutirely withdfawn, and the oppo
nents of the Bill, håving received money to sup
port it, discovered that instead of being opposed
to the interests of the public, it was an admirable
Bill. His hon. ffiend the member for York was
opposed to the principle of the Bill, but on the
question of price, there was no one on the com
mittee to examine witnesses and endeavour to
bring out facts but his right hon. friend the mem
ber for the City. There real ly was no evidence
that 20 years’ purchase was a fair price, and the
mode in Avhich the price had been fixed in this
case would be a bad precedeut. The Government
should not have fixed upon any number of years’
purchase, but should have inserted in the Bill the
usual compensation clause, and allowed the price
to be fixed as it was in all analogous cases. He
should, therefore, propose to introduce the com
mon clause relating to arbitration and referring
to the Consolidation Acts under which the arbi
tration would be made. As to the allegation that
in this Bill the precedent of the Railway Act of
1844 was followed, he must say that in the case
of that Act it was perfectly right to fix the num
ber of years’ purchase at which the railways which
might he brought under its operation were to be
purchased, because that Act passed before the Acts
incorporating the companies to which it referred.
That Act had only a prospective operation, and
the Legislature Avas justified in saying that if
railways, Avhich were not at that time in existence,
should under cértain circumstances have certain
advantages, they should also be subjected to cer
tain disabilities; but this Bill was retrospective
in its effect, and in the case of the purchase of
an existing property the invariable custom had
been not to fix the number of years’ purchase,
but to leave that to the arbitrator. The hon.
gentleman concluded by moving an amendment
the effect of Avhich was to provide that the price
to be given for the undertakings, &c., to be pur
chased under the Bill should be decided by arbi
tration as to their value in a manner to be „here
after provided.“

frem, uden hans høistærede Yen, Repræsentanten
for City. Der var i Yirkelighedeu intet Yidnes
byrd for, at 20 Aars Kjøb var en rimelig Pris og
den Maade, hvorpaa Prisen var bleven bestemt i
dette Tilfælde, vikle være en slet Præcedens. Re
gjeringen skulde ikke have bundet sig til noget
Antal Aars Kjøb, men skulde have indtaget i Billen
den sædvanlige Klausul om Kompensation og ladet
Prisen blive bestemt, som den var blevet det i alle
analoge Tilfælde. Han skulde derfor foreslaa at
indtage den sædvanlige Klausul som handler om
Voldgift og henvisende til de Consolidationslove,
under hvilke Yoldgiften vikle blive gjort. Hvad
den Paastand angaar, at man i nærværende Bill
har fulgt Jernbaneakten af 1844 som Præcedens,
maatte han sige, at i Tilfældet med denne Akt
var det fuldkommen rigtigt at bestemme Antallet
afAarsKjøb, efter hvilkct Jernbanerne, som maatte
komme under Aktens Virkning, skulde kjøbes, fordi
denne Akt gik igjennem før de Akter, der inkor
porerede de Kompagnier, til hvilke den refererede.
Denne Akt havde alene en prospektiv Virksomhed
og Lovgivningen havde Ret til at sige, at dersom
Jernbaner, som ikke paa den Tid existerede, skulde
under visse Omstændigheder have visse Fordele,
skulde de ogsaa være underkastede visse Restrik
tioner; men denne Bill var retrospektiv i sin Virk
ning og i Tilfælde af Kjøb af en existerende Eien
dom havde den uforanderlige Brug været, ikke at
fastsætte noget Antal af Aars Kjøb, men at over
lade dette til Yoldgift. Den ærede Taler sluttede
med at foreslaa et Amendement, som gik ud paa
at bestemme, at den Pris, der skulde gives for de
Forretninger etc., der skulde kjøbes ifølge Billen,
skulde afgjøres ved Voldgift angaaende deres Yærdi
paa en Maade „som herefter skal bestemmes.“
